Law Firm Books CleanupA fee and a settlement are not the same line.
For payments made in 2026 the reporting line depends on what the money was.
Mark the payment
For payments made in 2026 the reporting line depends on what the money was.
Mark the paymentFor payments made in 2026, the IRS reporting threshold for Form 1099-NEC is 2,000 dollars. The IRS page lists payments to attorneys, including law firms and other providers of legal services, on Form 1099-NEC. Gross proceeds paid to an attorney, such as in a settlement, are called out separately on Form 1099-MISC.
Payments made before 2026 used a 600 dollar threshold. Backup withholding is reported regardless of the amount. The log should say which kind of payment it was before anyone reaches for a form.
The owner has one envelope that holds a fee and a settlement from the same matter, and the question is which line each part belongs on. We mark the fee and the proceeds as two lines before a form is chosen. No client's name sits in that picture.
The attorney guide tells examiners to ask whether cash over 10,000 dollars was received and whether Forms 8300 were filed. It points to cases holding that, absent special circumstances, an attorney must disclose the client information those forms require. A state ethics rule is not, by itself, the special circumstance the guide discusses. This page does not give ethics advice. Publication 5602 says on its cover that it is not an official pronouncement of the law.
Picture one envelope that holds a fee and a settlement at the same time. We can all picture one payment that belongs to more than one person. A proceeds log is that envelope written down. Each payment needs its own name before the year is filed.
A useful log has four columns and no drama. Who was paid. What the payment was, a fee or proceeds. The date. The form that payment belongs on. A settlement that was handed to another lawyer is proceeds even when the firm also earned a fee from the same matter. Those are two lines, not one blended number.
Backup withholding does not wait for the threshold. If it was withheld, it is reported. Cash over 10,000 dollars raises the Form 8300 question the attorney guide already tells examiners to ask. This page does not decide the ethics of a name on that form. It only says the question exists, and the cover of Publication 5602 still says the guide is not the Service's official position.
The income tax return is a different filing, and it lives with the entity type on the home page. Do not let a 1099 question swallow the estimated tax dates, and do not let an estimated payment decide which information return a settlement used. They share a year. They do not share a form.
Name the calendar year before a late form touches it. We mark each payment as a fee or as proceeds before a form is chosen, then we look at the return so a settlement is not quietly folded into fee income. Estimated tax is a different calendar. Estimated payments for a lawyer who owes them land on the April, June, September, and January fifteenths, and none of those four days chooses Form 1099-NEC or Form 1099-MISC. Bring the payment log while that year is still open.
